1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of nyxbpo.net (the "Site"), any account you create on the Site, and any engagement of Nyx BPO's outsourced business process services (the "Services"). By using the Site, creating an account, or engaging the Services, you agree to be bound by these Terms. Specific engagements will also be governed by a separate signed service agreement or statement of work, which takes precedence over these Terms in the event of conflict.
2. Our Services
Nyx BPO provides outsourced business process services, including but not limited to customer support and call center operations, sales, supply chain coordination, e-commerce operations, travel agency support, real estate support, solar customer care, telecom services, and shipping and delivery coordination. Exact scope, staffing, service levels, and pricing for any engagement are defined in a separate agreement between Nyx BPO and the client.
3. Accounts
Creating an account requires accurate information and a secure password. You are responsible for all activity under your account and must notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.
4. Use of the Site
- You agree to use the Site only for lawful purposes and in a manner consistent with these Terms
- You will not attempt to interfere with the Site's functionality, security, or availability
- You will not misrepresent your identity or affiliation when contacting us or registering an account
- Content on the Site is for general informational purposes and does not constitute a binding offer of services
5. Client Engagements
Any engagement of our Services is subject to a separate written agreement covering scope, service levels, fees, confidentiality, and data processing terms. Nothing on this Site constitutes a guarantee of specific results, pricing, or availability outside of a signed agreement.
6. Confidentiality
In the course of delivering Services, Nyx BPO may receive confidential or proprietary information from clients and their customers. We treat such information as confidential and use it solely to perform the agreed Services, in line with the terms of the applicable service agreement and our Privacy Policy.
7. Intellectual Property
All content on the Site, including text, graphics, logos, and design, is the property of Nyx BPO or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without our prior written consent.
8. Limitation of Liability
To the fullest extent permitted by law, Nyx BPO shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or the Services, except as expressly set out in a signed service agreement. Liability arising from a specific client engagement is governed exclusively by the terms of that engagement's service agreement.
9. Termination
We may suspend or restrict access to the Site or an account at our discretion, without notice, for conduct that violates these Terms or is otherwise harmful to Nyx BPO or third parties. Termination of a Services engagement is governed by the applicable service agreement.
10. Changes to These Terms
We may revise these Terms from time to time. The "Last updated" date above reflects the most recent revision. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
11. Governing Law
These Terms are governed by the laws of the jurisdiction in which Nyx BPO is established, without regard to conflict-of-law principles, unless otherwise specified in a signed service agreement.
